Welcome to Digvera. These Terms of Service ("Terms") govern your access to and use of all Digvera products and services — including ClientRadar (clientradar.digvera.com), ApplyRadar (apply.digvera.com), and Ai Assistant (ai.digvera.com) — collectively referred to as the "Service." Please read these Terms carefully.

1. Acceptance of Terms

By accessing or using any Digvera product, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our Service.

These Terms constitute a legally binding agreement between you and Digvera. Your continued use of the Service constitutes acceptance of any changes to these Terms.

2. Description of Service

Digvera operates three interconnected freelance intelligence products:

2.1 ClientRadar clientradar.digvera.com

A freelance project aggregation platform that:

• Aggregates Projects: Collects and displays freelance listings from RemoteOK, Freelancer.com, We Work Remotely, Jobicy, Guru.com, Remotive, and others
• Provides Search and Filtering: Enables users to search and filter projects by category, source, and criteria
• Sends Notifications: Delivers email alerts about new projects based on preferences
• Generates AI Proposals: Offers AI-powered proposal generation for Starter and Pro subscribers

2.2 ApplyRadar apply.digvera.com

An AI-powered job matching platform that:

• Matches Projects: Uses AI to rank scraped opportunities by your win probability score
• Predicts Success: Provides win prediction scores and smart pricing suggestions
• Analyzes Skills: Identifies skill gaps and learning opportunities
• Automates Applications: Offers Auto-Apply automation on Pro plans

2.3 Ai Assistant ai.digvera.com

A conversational AI career coach for freelancers that:

• Provides 7 AI Modes: AI Chat, Find Jobs, Write Proposal, Build Resume, Smart Pricing, Learning Path, and Send Email
• Uses a Credit System: Operates on a pay-as-you-go credit model — each AI request consumes 1 credit
• Personalizes Responses: Uses your stored profile to tailor all outputs to your skills and experience
• Supports Multiple Languages: Provides responses in 8 languages

3. Eligibility

To use any Digvera product, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information
• Not have been previously banned or suspended from the Service

4. User Accounts

4.1 Account Creation

Each Digvera product maintains a separate account system. To access features, you must create an account by providing a valid email address and optional profile information. Accounts on ClientRadar, ApplyRadar, and Ai Assistant are independent of each other.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

4.3 Account Restrictions

• One Account Per Person: You may only create one account per product
• No Sharing: Do not share your account credentials with others
• No Transfer: You cannot transfer your account to another person
• No Bot Accounts: Automated account creation is prohibited

5. Subscription and Payments

5.3 Ai Assistant Credit Packs AI

Ai Assistant operates on a pay-as-you-go credit system. There is no monthly subscription — users purchase one-time credit packs:

5.4 CR/AR Proposal Credit Packs

ClientRadar and ApplyRadar subscribers may also purchase additional proposal credits:

• Credit Pack — $5: 200 additional AI proposals added to your account
• Available to Starter and Pro plan holders only (not Free plan)
• Credits do not expire and stack with monthly allowance
• Non-refundable once any proposals have been generated

5.5 Stack Bundle

Stack Bundle — $69/month: Includes both ClientRadar Pro and ApplyRadar Pro. Saves $10/month compared to buying separately. Ai Assistant credits are purchased separately.

5.6 Payment Terms

• Payment Processor: All payments are processed securely through Lemon Squeezy
• Billing Cycle: Monthly and annual subscriptions renew automatically
• Credit Packs: One-time purchases, charged immediately, non-recurring
• Auto-Renewal: Subscriptions auto-renew unless cancelled before renewal date
• Price Changes: We reserve the right to change pricing with 30 days notice
• Currency: All prices are in USD

5.7 Cancellation and Refunds

• Subscriptions: Cancel anytime from account settings — access continues until end of billing period
• Refund Policy: See our Refund Policy — 14-day money-back guarantee on new subscriptions
• Credit Packs: Non-refundable once any credits have been used
• No Partial Refunds: No prorated refunds for early cancellation outside refund window

6. Acceptable Use Policy

6.1 Permitted Use

You may use Digvera products to:

• Search for and discover freelance opportunities
• Generate proposals, resumes, and other career content using AI tools
• Receive notifications and alerts about relevant projects
• Manage your account and freelance workflow
• Use AI-generated content for your own professional applications

6.2 Prohibited Activities

6.3 Consequences of Violation

Violations may result in immediate account suspension or termination, forfeiture of remaining credits or subscription without refund, legal action if applicable, and reporting to relevant authorities.

7. Intellectual Property

7.1 Our Rights

All Digvera products and related content, features, and functionality are owned by Digvera and protected by copyright, trademark, and other intellectual property laws. This includes website design, branding, software code, algorithms, AI systems, aggregation technology, and all product interfaces.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal professional use, and to use AI-generated content (proposals, resumes, emails) for your own applications. This license does not include any right to modify, copy, distribute, or reverse engineer our systems.

7.3 Third-Party Content

Project listings displayed on our platforms are sourced from third-party platforms and remain the property of their respective owners. We aggregate this publicly available information under fair use principles.

8. User Content

You may provide content including profile information, preferences, and feedback. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to store and process your content to provide the Service, and to use aggregated, anonymized data to improve our products. You represent that you own or have rights to any content you submit and that it does not violate any laws.

9. Third-Party Content and Links

Our products contain links to external platforms. We are not responsible for the content, privacy practices, or terms of third-party sites. When you click a project link, you leave our platform and enter a third-party environment — all applications must follow that platform's own terms.

10. AI Services and Generated Content

10.1 Nature of AI Output

AI-generated content — including proposals, resumes, pricing suggestions, job matches, and chat responses — is produced by automated systems. You acknowledge that:

• AI outputs may contain errors, inaccuracies, or outdated information
• AI-generated proposals are starting points and should be reviewed and personalized before use
• Win prediction scores and pricing suggestions are estimates, not guarantees
• AI responses do not constitute professional legal, financial, or career advice

10.2 Ownership of AI Output

AI-generated content produced using your inputs and credits is yours to use for personal professional purposes. You may use generated proposals, resumes, and emails in your own freelance applications. You may not resell, distribute, or commercially exploit AI outputs as a standalone product or service.

10.3 Credit Consumption

For Ai Assistant specifically:

• Each AI request consumes exactly 1 credit from your balance
• Credits are deducted only upon successful AI response delivery
• Failed requests due to server errors do not consume credits
• Credits consumed due to user-initiated requests (including requests for content later deemed unsatisfactory) are non-refundable
• We reserve the right to adjust credit consumption rates with notice

10.4 AI Content Restrictions

You may not use Ai Assistant or any AI feature to generate:

• Fraudulent, misleading, or deceptive content
• Content that violates any applicable laws or third-party rights
• Spam or unsolicited mass communications
• Content intended to harm, harass, or deceive any individual or organization

10.5 AI Service Availability

AI features depend on third-party AI model providers. We do not guarantee uninterrupted AI service availability. In the event of prolonged AI service outages, we will make reasonable efforts to notify affected users and may provide credit adjustments at our discretion.

11. Disclaimers and Warranties

11.1 "AS IS" Service

All Digvera products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including merchantability, fitness for a particular purpose, non-infringement, accuracy or completeness of content, uninterrupted or error-free operation, or accuracy of AI-generated outputs.

11.2 No Guarantee of Results

We do not guarantee that you will find suitable projects, be hired or awarded contracts, that project listings are accurate or current, that clients are legitimate, that AI-generated proposals will be successful, or that win prediction scores reflect actual outcomes.

11.3 Availability

We do not guarantee the Service will be available at all times, that AI features will operate without interruption, or that defects will be corrected immediately.

12. Limitation of Liability

Maximum Liability: Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Digvera and our affiliates from any claims, liabilities, damages, losses, and expenses arising from your use or misuse of the Service, your violation of these Terms, your use of AI-generated content, your violation of any third-party rights, or any fraudulent or illegal activities.

14. Termination

14.1 By You

You may terminate your account at any time by cancelling your subscription, requesting account deletion via email, or stopping use of the Service.

14.2 By Us

We may suspend or terminate your account immediately, without notice, if you violate these Terms, engage in prohibited activities, we are required to do so by law, or we discontinue the Service.

14.3 Effect of Termination

Upon termination, your access ceases immediately, account data may be deleted after 30 days, no refunds will be provided except as per our Refund Policy, and any unused proposal credits or Ai Assistant credits will be forfeited.

15. Modifications to Service and Terms

We reserve the right to modify or discontinue any part of any product, change features or functionality, update pricing with 30 days notice, and add or remove AI capabilities. We may update these Terms at any time. Significant changes will be communicated via email. Continued use constitutes acceptance.

16. Governing Law and Disputes

16.1 Governing Law

These Terms are governed by generally accepted principles of international commercial law. To the extent a specific jurisdiction must be designated, the laws of the Republic of Turkey shall apply, without regard to conflict of law principles.

16.2 Dispute Resolution

1. Informal Resolution: Contact us first to resolve the issue informally
2. Negotiation: We'll work with you to reach a fair resolution within 30 days
3. Mediation: If needed, disputes may be submitted to mediation
4. Arbitration/Litigation: As a last resort, formal proceedings may be necessary

16.3 Class Action Waiver

You agree to resolve disputes on an individual basis only, not as part of a class action or collective proceeding.

17. Miscellaneous

17.1 Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Digvera across all products.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

17.4 Assignment

You cannot assign or transfer these Terms. Digvera may assign rights and obligations without restriction.

17.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including AI provider outages.

17.6 Language

These Terms are written in English. Any translations are for convenience only.
